malaaky.com is a marketplace platform that connects brands with content creators ("Creators") for User-Generated Content (UGC) services. We provide a platform for:
- Brands to browse and hire verified Egyptian creators
- Creators to offer UGC services including TikTok, Instagram, and YouTube content
- Secure payment processing and escrow services
- Communication tools for project collaboration
- Order management and delivery tracking
3. User Accounts and Eligibility
To use our services, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Be at least 18 years old and have legal capacity to enter contracts
- Use the platform for legitimate business purposes only
4. Creator Verification
Creators undergo a verification process that may include:
- Identity verification (government-issued ID)
- Social media account verification
- Portfolio review and quality assessment
- Background checks for fraud prevention
Verified Creator status does not guarantee quality or outcomes. Brands should review Creator profiles and portfolios before hiring.
5. Orders and Payments
Order Process: Brands create orders by selecting a Creator and describing their requirements. Creators accept or decline orders based on their capabilities.
Payment Terms: Full payment is required upfront and held in escrow. Funds are released to the Creator upon successful delivery and approval of content, or after the revision period expires.
Refunds: Refunds are available if: (a) Creator fails to deliver content, (b) Content does not meet basic requirements, or (c) Order is cancelled before work begins.
6. Content and Intellectual Property
Creator Content: Upon full payment, the intellectual property rights to delivered content transfer to the Brand, unless otherwise agreed.
Platform Content: All content on malaaky.com, including logos, designs, and text, remains the property of malaaky.com. Users may not reproduce or distribute platform content without permission.
User-Submitted Content: Users retain ownership of content they submit but grant malaaky.com a license to use it for platform operations.
7. Prohibited Activities
Users agree NOT to:
- Engage in fraud, scams, or illegal activities
- Harass, threaten, or defame other users
- Post inappropriate, offensive, or illegal content
- Attempt to circumvent the platform or payment system
- Share account credentials with others
- Use the platform for competing services or solicitation
- Request or provide services involving illegal content
8. Dispute Resolution
If disputes arise, users should first attempt to resolve directly through our messaging system. If unresolved, malaaky.com will mediate based on evidence provided.
Our dispute resolution process: (1) User submits complaint, (2) Other party responds within 48 hours, (3) malaaky.com reviews and makes a decision within 5 business days.
9. Limitation of Liability
malaaky.com acts as a marketplace intermediary. We do not guarantee the quality of Creator services or the accuracy of User representations. Users use the platform at their own risk.
We are not liable for: (a) User disputes between Brands and Creators, (b) Content that infringes third-party rights, (c) Service interruptions or data loss, (d) Any indirect, incidental, or consequential damages.
10. Indemnification
You agree to indemnify and hold harmless malaaky.com, its affiliates, officers, and employees from any claims, damages, losses, or expenses arising from your use of the platform or violation of these terms.
11. Modification of Terms
We may modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms. We will notify users of significant changes via email or platform notice.
12. Termination
We may suspend or terminate accounts that violate these terms or for any other reason at our sole discretion. Users may delete their account at any time by contacting support.
13. Governing Law
These terms are governed by the laws of Egypt. Any legal disputes shall be resolved in Egyptian courts, with Cairo as the exclusive jurisdiction.
